By accessing this website, you agree to accept, without limitation or criterion, all of these terms and conditions of use (the 'Terms'). Please read this page carefully. The Terms is made between BuddyPlace.my ('we','us' or 'our') and the customer who purchases voucher ('you', 'your' or 'Customer') offered by Merchant ('Merchant'). If you do not agree to the Terms and conditions, you are not authorized to use this site.

1. The term ('you', 'your' or 'Customer') refers to the person or the organization or company accessing or using the Site and/or our Services.
2. The term ('Merchant') is a third party that selling and/or providing deals either in products type or service.
3. The term ('we', 'us' or 'our') is referring to BuddyPlace Sdn Bhd. We are responsible to provide an online social marketing media providing a forum for the marketing and sales of various products and services for client who subcribe to the concepts and strategy by BuddyPlace.my (the 'Forum').

1. You must be at least 18 years old to be eligible to use the Site. However, if you are at least 13 years old but not yet 18, you may use the Site in conjunction with your parent or guardian who agrees to this Agreement. No one under age 13 may use the Site.

You must be responsible for maintaining any equipment such as computer hardware, computer software and other equipment that are needed to access and use the Site. There is no warranty for the Site and the content will be error-free, virus-free uninterrupted or free from unauthorized use or hackers. However, we always make efforts to make sure everyone can access this site securely.

1. Account Creation

   You are required to create an account with BuddyPlace and provide complete, truthful and accurate information in order to access, browse or in any way to use the services offered by the Site. This can be done either by registering directly on our Site or by allowing a BuddyPlaces.my application to connect through your Facebook or Twitter profile. There are 2 types of account:

   • Customer - This account is for users who are interest to buy the deals, give review and rate.
   • Merchant - This account is for users who are interest to offer a discount for their products/services to customer.
2. Username and Password

   By using this site and services, you represent that you will be responsible for maintaining your account and password and for restricting access to your computer. We will accept the instructions of any individual who claims to be authorized to direct changes to your account so long as such person presents your username and password or provides other appropriate account identifying information as determined by us in our discretion, by email or by phone, or through which you access the BuddyPlace.my. We shall not be responsible for the actions of any individuals who misuse or misappropriate your assets using your username and password or other appropriate account identifying information.

3. Termination
   • Termination by BuddyPlace
     BuddyPlace.my reserves the right to terminate this Terms with you without prior notice. We shall have the right to suspend or terminate your account if any information provided during registration is deemed to be inaccurate, not current or incomplete.
   • Termination by You
     You may terminate this Terms at any time by closing your account through the Site. There are no refunds for any fees paid. You are responsible for terminating your account and we shall not responsible for your failure to terminate your account and the terms properly.

Online Marketing Agreement is an agreement between BuddyPlace.my and the Merchant that contains the details between both parties (the Schedule).

1. Commencement /Expiration of the Forum

   The provision of the Terms commences as on the date prescribes in Commencement Date of the Schedule when the products/services of the Merchant appear and potential customer can access to the Terms and shall be expired at the date as stipulated in Expiry Date of the Schedule.

2. Placement of Purchase

   The Merchant is aware and agreed that the Forum only provides a general term on the use and a more specific term on the specifications and description of products/services will be provided by the Merchant as describe in Description of Product/Services of the Schedule and shall appear with products/services so marketed. Any potential customer who make any purchase must be presumed to have read the terms and conditions stated herein.

3. Mode of Payment by Customer

   The Merchant is fully aware that any intended customer will have to fill up the appropriate form prior to place a purchase and upon payment via credit card and online transfer in accordance to the procedures stipulated in the Forum, to the appointed gateway company, the customer will obtain the necessary document to entitle him to the procurement of the products/services from the Merchant. A specific terms and conditions on the products/services appear on the marketing page of the Merchant at the Forum.

4. Consideration (Fee)

   Upon clearance and receipt from the gateway company, the company shall reimbursed the Merchant the agreed price of the product/services after deducting the agreed fee 15 days after the expiry date of the Forum as stipulated in Consideration of the Schedule. The one time full amount payment is made after deducting any fraud purchase or reversed/returned purchase.

5. Notice

   Any notice or demand required to be served by either party to the other under provision of this agreement shall be in writing and shall be deemed to be sufficiently served.

6. Warranties

   The Merchant warrants and undertakes that the products/services are marketed at the Forum are similar and the merchantable quality when receive by the paid customer/s; and all specific details on the terms and conditions are provided by and Merchant agree to take full responsibility as to the accuracy and authenticity of products/services.

7. Indemnity

   The Merchant hereto agrees to indemnity the Company against, and hold the Company harmless from any and all losses, damages, actions, proceedings, claims, demands, expenses and cost that the Company may sustain in respect of any arising directly or indirectly from the products/services of the Merchant.

8. Governing law

   This Online Marketing Agreement shall be governed by and construed in accordance with the Malaysian Law and the Parties hereto agree to submit any dispute to the jurisdiction of the Malaysian Courts.

9. Exclusion of Liability

   Notwithstanding anything herein contained the Company shall not be liable to the Merchant for any issues arising therefrom the products/services and not shall the Merchant has any claim against the Company in respect of any act or omission of the Company or its servants or agents in respect of performance of any duty on the part of the Company herein contained.

   Any communications or materials You or Third Party submit to BuddyPlace.my, through the website, by electronic mail or otherwise, including any data, profile information, review, messages, questions, comments, suggestions, ideas, or the like ("Your Content") will be treated as non-confidential, non-proprietary and irrevocably. By voluntary submitting to us Your Content, you hereby grant BuddyPlace.my, and all users of the site, a worldwide, non-exclusive, royalty free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish and translate the contents of the Site in any form, media or technology. We assume no responsibility for any communications or materials posted or submitted, or for the return or such communications or materials.

   We and other parties are the exclusive copyright owners of the Site and all works of authorship contained in the Site, including without limitation source code, graphics, design, visual interfaces, interactive features and other usage-related data ("Our Content"). 3. Prohibited Content

   BuddyPlace.my may, in our sole discretion, immediately disable your access to our Site if we believe that you have violated any of the policies listed below or the Terms. We prohibit the use of the by any person or entity that:

8. Merchant reserves absolute rights to reject redemption request on any Expired, Fraudulent, Redeemed or Duplicated vouchers.
